Pravila privatnosti
Stupaju na snagu: 5. studenoga 2026.
1. Voditelj obrade i kontakt
1.1. Ovim Pravilima privatnosti (dalje: Pravila) ArdiGold d.o.o., Kolodvorska ulica 8, Dugo Selo, Republika Hrvatska, OIB 25836495488 (dalje: Voditelj obrade), u skladu s člancima 13. i 14. Uredbe (EU) 2016/679 (Opća uredba o zaštiti podataka, dalje: GDPR), obavještava korisnike mobilne aplikacije i web stranice Luna (dalje: Usluga; korisnici Usluge dalje: Korisnik) te druge ispitanike o obradi njihovih osobnih podataka.
2. Kategorije osobnih podataka
Voditelj obrade obrađuje sljedeće kategorije osobnih podataka, u opsegu u kojem ih Korisnik daje ili u kojem nastaju korištenjem Usluge:
a) identifikacijski i kontaktni podaci: ime i prezime, adresa e-pošte, broj telefona, slika profila, način prijave;
b) podaci o postavkama: jezik, postavke vezane uz nakit, okvirni budžet i važni datumi, ako ih Korisnik unese;
c) podaci o aktivnosti u Usluzi: označeni i preskočeni proizvodi, spremljeni proizvodi, košarica, nacrti i spremljeni prijedlozi, poruke i upiti upućeni Usluzi, recenzije;
d) podaci o narudžbama i plaćanju: adresa ili mjesto dostave, sadržaj i povijest narudžbi, povrata i zamjena, poruke uz narudžbu, mjere i posvete za proizvode izrađene po narudžbi, način i status plaćanja; puni podaci platne kartice ne pohranjuju se u sustavima Voditelja obrade;
e) fotografije i glas: fotografije i glasovni zapisi koje Korisnik dobrovoljno preda pri korištenju funkcionalnosti koja ih zahtijeva;
f) podaci o lokaciji: samo uz dopuštenje u postavkama uređaja, koje se traži tek kad Korisnik bira mjesto preuzimanja, i samo dok se Usluga koristi;
g) podaci o otkupu nošenog nakita: opis i fotografije predmeta, željena cijena, poruke Zlatarni te podaci potrebni za isplatu, pri čemu se od platne kartice pohranjuju samo marka kartice i posljednje četiri znamenke;
h) podaci o povezanim korisnicima i zajedničkom odabiru proizvoda: odnosi s drugim korisnicima koje Korisnik uspostavi, podaci koje oni odluče podijeliti te podaci o osobi kojoj je poklon namijenjen, ako ih Korisnik unese;
i) tehnički podaci i podaci o uređaju: identifikator uređaja za obavijesti, platforma i inačica aplikacije, tehnički podaci o greškama i rušenjima, IP adresa i zapisi o pristupu;
j) podaci o korištenju: podaci o načinu korištenja Usluge, samo ako Korisnik na to pristane (odjeljak 5);
k) komunikacija s podrškom: sadržaj upita i odgovora.
3. Izvori osobnih podataka
3.1. Osobne podatke Voditelj obrade prikuplja ponajprije izravno od Korisnika.
4. Svrhe i pravne osnove obrade
• Otvaranje i vođenje korisničkog računa – izvršenje ugovora, čl. 6. st. 1. t. (b)
• Posredovanje u narudžbama i, kad je Voditelj obrade prodavatelj, izvršenje kupoprodajnog ugovora; plaćanje, dostava, povrati, reklamacije i otkup nošenog nakita – izvršenje ugovora, čl. 6. st. 1. t. (b)
• Podrška korisnicima – izvršenje ugovora, čl. 6. st. 1. t. (b), i legitimni interes, t. (f)
• Prilagodba preporuka proizvoda (profiliranje, odjeljak 7) – legitimni interes, čl. 6. st. 1. t. (f)
• Dijeljenje podataka s povezanim korisnicima (odjeljak 8) – privola osobe koja dijeli, čl. 6. st. 1. t. (a)
• Zajednički odabir proizvoda s drugim korisnicima (odjeljak 8) – izvršenje ugovora, čl. 6. st. 1. t. (b); ime osobe kojoj je poklon namijenjen: legitimni interes, t. (f)
• Push obavijesti – privola, čl. 6. st. 1. t. (a), dana u postavkama uređaja

• Bilježenje korištenja Usluge – privola, čl. 6. st. 1. t. (a)
• Kolačići i mjerenje oglašavanja na web stranici – privola, čl. 6. st. 1. t. (a)
• Prijedlog najbližih mjesta preuzimanja i, uz već danu dozvolu, prikaz vremenskih uvjeta u sučelju – privola, čl. 6. st. 1. t. (a), dana u postavkama uređaja
• Dijagnostika grešaka i stabilnost Usluge – legitimni interes, čl. 6. st. 1. t. (f)

• Postavljanje, ostvarivanje ili obrana pravnih zahtjeva – legitimni interes, čl. 6. st. 1. t. (f)
Legitimni interes.
5. Komunikacija i bilježenje korištenja
6. Funkcionalnosti koje se temelje na umjetnoj inteligenciji
6.1. Dio funkcionalnosti Usluge (pretraga tekstom, slikom i glasom, oblikovanje i prilagodba nakita, prijedlozi proizvoda i kompleta te virtualni prikaz nakita) koristi usluge umjetne inteligencije vanjskog pružatelja.
GDPR-a.
7. Automatizirano odlučivanje i profiliranje
7.1. Voditelj obrade na temelju aktivnosti Korisnika u Usluzi (označeni, preskočeni, spremljeni i kupljeni proizvodi) automatizirano procjenjuje njegove sklonosti kako bi mu prikazao relevantnije proizvode. To je profiliranje u smislu članka 4. točke 4. GDPR-a.
GDPR-a.
8. Povezani korisnici i zajednički odabir proizvoda
8.1. Povezani korisnici.
GDPR-a pruža ovim Pravilima (čl. 14. st. 5. t. (b) GDPR-a).
9. Primatelji osobnih podataka
a) pružateljima usluga smještaja i pohrane podataka te usluga prijave;
b) pružateljima usluga umjetne inteligencije, samo uz privolu (odjeljak 6);
c) pružateljima usluga plaćanja, uključujući odgođeno plaćanje gdje je dostupno, te pružateljima usluga sprječavanja prijevara;
d) pružateljima usluga slanja e-pošte i push obavijesti, uključujući operatere mobilnih platformi;
e) pružateljima usluga dijagnostike grešaka i statistike posjeta web stranici bez kolačića;
f) pružateljima usluga vremenske prognoze, kojima se šalje samo lokacija zaokružena na približno 10 km, te pružateljima kartografskih usluga za prikaz karte mjesta preuzimanja;
g) pružateljima usluga prijave i digitalnih novčanika, kad ih Korisnik odabere;
h) pružateljima usluga dostave i paketomata, samo za dostavu;
i) Zlatarnama, za narudžbe koje izvršavaju i otkupe koje provode (odjeljak 9.3);
j) pružatelju usluga mjerenja i oglašavanja na web stranici, samo uz privolu (odjeljak 14);
k) tijelima javne vlasti, kad to propisuje zakon;
9.4. Voditelj obrade ne prodaje osobne podatke.
10. Prijenos u treće zemlje
10.1. Pojedini primatelji imaju sjedište ili obrađuju podatke izvan Europskog gospodarskog prostora, uključujući Sjedinjene Američke Države.
a) podaci o računu, postavke i aktivnost, uključujući nacrte, razgovore i spremljene prijedloge: dok postoji korisnički račun; brišu se bez odgode brisanjem računa, a spremljeni sadržaj i ranije, kad ga Korisnik obriše;
a1) podaci korištenja bez otvorenog računa: brišu se nakon 90 dana neaktivnosti, osim ako su vezani uz narudžbu, otkup ili plaćanje;
b) fotografije i glasovni zapisi za funkcionalnosti iz odjeljka 6: ne pohranjuju se, nego se obrađuju samo za vrijeme izvršenja funkcionalnosti; dobiveni prikazi pohranjuju se samo na uređaju Korisnika;
c) prijedlozi koje Korisnik ne spremi: samo za vrijeme obrade, bez trajne pohrane;
d) podaci o otkupu nošenog nakita: za vrijeme trajanja prijave, a za otkupljeni predmet onoliko koliko je potrebno kao zapis o otkupu i za oglašavanje predmeta;
e) podaci o narudžbama, računima i plaćanjima: onoliko koliko propisuju računovodstveni i porezni propisi, za račune u Republici Hrvatskoj u pravilu 11 godina; Zlatarna i pružatelj usluga plaćanja čuvaju ih u skladu s vlastitim obvezama;
f) zajednički odabir proizvoda: zatvoren ili istekao 90 dana, a onaj za koji je izvršena narudžba 25 mjeseci; brisanjem računa brišu se i zajednički odabiri koje je Korisnik pokrenuo, dok stavke koje je dodao u tuđe odabire ostaju bez oznake autora;
g) podaci o korištenju: dok postoji račun, pri čemu se zapisi stariji od 180 dana redovito brišu;
g1) zapisi o pozivima prema uslugama umjetne inteligencije, bez sadržaja upita i rezultata: 180 dana, nakon čega se automatski brišu;

i) tehnički podaci o greškama i rušenjima: 90 dana;
j) sigurnosni zapisi o pristupu: do 7 dana;
k) komunikacija s podrškom: do tri godine od posljednje poruke, a dulje samo ako je to potrebno radi ostvarivanja ili obrane pravnih zahtjeva;
l) podaci o povezanim korisnicima: dok traje veza, a najdulje dok postoji račun;
m) podaci prikupljeni kolačićima na web stranici: rokovi navedeni u obavijesti o kolačićima;
n) podaci o lokaciji: ne pohranjuju se.
14. Web stranica i kolačići
Uz privolu, pružatelj usluga mjerenja i oglašavanja prima podatke o posjetu i pregledanim sadržajima te tehničke podatke preglednika, radi mjerenja i poboljšanja oglašavanja Voditelja obrade.
15. Fotografije i posebne kategorije podataka
GDPR-a.
U slučaju povrede osobnih podataka Voditelj obrade postupa u skladu s člancima 33. i 34. GDPR-a.
17. Maloljetnici

Privacy Policy
Effective date: 5 November 2026
1. Controller and contact
1.1. By this Privacy Policy (the “Policy”), ArdiGold d.o.o., Kolodvorska ulica 8, Dugo Selo, Republic of Croatia, OIB (Croatian identification number) 25836495488 (the “Controller”), in accordance with Articles 13 and 14 of Regulation (EU) 2016/679 (General Data Protection Regulation, the “GDPR”), informs users of the Luna mobile application and website (the “Service”; users of the Service, each a “User”) and other data subjects about the processing of their personal data.
1.2. Contact for all data protection matters and for exercising data subject rights: email support@luna-discovery.com. No data protection officer has been designated, as there is no legal obligation to do so.
1.3. The Service is an online platform connecting users with jewelers. Products are sold by the jeweler named next to the product and in the order (the “Jeweler”). The seller may also be the Controller itself when it sells its own products. With respect to the personal data the Jeweler needs to perform an order or a buyout, the Jeweler is a separate controller (Section 9.3).
2. Categories of personal data
The Controller processes the following categories of personal data, to the extent provided by the User or generated through use of the Service:
a) identification and contact data: first name and surname, email address, telephone number, profile picture, sign-in method;
b) preference data: language, jewelry-related preferences, indicative budget and important dates, if entered by the User;
c) activity data: liked and skipped products, saved products, cart, designs and saved suggestions, messages and queries addressed to the Service, reviews;
d) order and payment data: delivery address or location, content and history of orders, returns and exchanges, order messages, measurements and engravings for made-to-order products, payment method and status; full payment card details are not stored in the Controller’s systems;
e) photographs and voice: photographs and voice recordings voluntarily provided by the User when using a feature that requires them;
f) location data: only with permission granted in the device settings, which is requested only when the User selects a pick-up point, and only while the Service is in use;
g) pre-owned jewelry buyout data: description and photographs of the item, asking price, messages to the Jeweler and data required for payout, of which only the card brand and last four digits of the payment card are stored;
h) data on connected users and joint product selection: relationships the User establishes with other users, data those users choose to share, and data on the gift recipient, if entered by the User;
i) technical and device data: device identifier for notifications, platform and app version, technical error and crash data, IP address and access logs;
j) usage data: data on how the Service is used, only with the User’s consent (Section 5);
k) support communications: content of enquiries and replies.
3. Sources of personal data
3.1. The Controller primarily collects personal data directly from the User.
3.2. Certain data is obtained from third parties: from the sign-in provider the User chooses (name and email address), from the Jeweler (status of orders, buyouts, returns and complaints), from payment and delivery service providers (payment and shipment status), and from other users (Section 8).
4. Purposes and legal bases of processing
• Creating and managing the user account – performance of a contract, Art. 6(1)(b)
• Intermediation of orders and, where the Controller is the seller, performance of the sales contract; payment, delivery, returns, complaints and buyout of pre-owned jewelry – performance of a contract, Art. 6(1)(b)
• Customer support – performance of a contract, Art. 6(1)(b), and legitimate interest, Art. 6(1)(f)
• Personalisation of product recommendations (profiling, Section 7) – legitimate interest, Art. 6(1)(f)
• Features based on artificial intelligence (Section 6) – consent, Art. 6(1)(a)
• Sharing data with connected users (Section 8) – consent of the sharing person, Art. 6(1)(a)
• Joint product selection with other users (Section 8) – performance of a contract, Art. 6(1)(b); name of the gift recipient: legitimate interest, Art. 6(1)(f)
• Push notifications – consent, Art. 6(1)(a), given in the device settings
• Account and order emails – performance of a contract, Art. 6(1)(b)
• Usage recording – consent, Art. 6(1)(a)
• Cookies and advertising measurement on the website – consent, Art. 6(1)(a)
• Suggesting the nearest pick-up points and, where permission has already been given, showing weather conditions in the interface – consent, Art. 6(1)(a), given in the device settings
• Error diagnostics and stability of the Service – legitimate interest, Art. 6(1)(f)
• Security of the Service and prevention of abuse and fraud – legitimate interest, Art. 6(1)(f)
• Accounting, tax and consumer protection obligations – legal obligation, Art. 6(1)(c)
• Establishment, exercise or defence of legal claims – legitimate interest, Art. 6(1)(f)
Legitimate interest. Where processing is based on legitimate interest, that interest consists of providing relevant content to the User, ensuring the stable and secure operation of the Service, preventing abuse and fraud, responding effectively to User enquiries, enabling a joint gift selection for a person named by the User, and establishing, exercising or defending legal claims. The Controller has assessed that these interests are not overridden by the interests and fundamental rights of the User, since processing is limited to what is necessary and produces no legal effects. The User may object to such processing at any time (Section 12).
Consent. Consent is given freely and may be withdrawn at any time in the app settings, in the device settings or via the contact in Section 1.2. Withdrawal does not affect the lawfulness of processing carried out before withdrawal.
5. Communications and usage recording
5.1. Push notifications are sent only if the User allows them in the device settings. Once the User allows them, all notification topics are enabled, including promotional notifications about discounts and sales. The User may separately disable each promotional and informational topic in the app settings; notifications about orders and returns are sent while push notifications are allowed. Permission is withdrawn in the device settings.
5.2. The Controller does not send promotional email. Email is used only for messages relating to the account and orders and for notifications the User has requested.
5.3. Usage recording is never enabled by default. It is enabled only on the basis of the User’s express consent, does not include photographs or the content of queries, and is not shared with third parties for advertising purposes. The User may disable it in the app’s privacy settings.
6. Features based on artificial intelligence
6.1. Certain features of the Service (search by text, image and voice, design and customisation of jewelry, product and set suggestions, and virtual jewelry previews) use artificial intelligence services of an external provider.
6.2. Before data is transmitted for the first time, the app informs the User which data is transmitted and to whom, and asks for consent. Without consent, no data is transmitted. Consent may be withdrawn in the app’s privacy settings.
6.3. Only data necessary for the feature the User starts is transmitted, and only while the User is using it: the content of queries and messages, photographs and voice recordings the User provides, jewelry-related wishes and measurements the User states, and descriptions of products from the User’s activity in the Service. Identification and contact data, address, location data and payment data are not transmitted. By way of exception, the first name of a connected user is transmitted only where necessary for the feature the User has requested and only with that connected user’s consent.
6.4. The artificial intelligence provider processes data as a processor, solely to return the result, under a data processing agreement. Under its contractual terms, data is not used to train models; the provider may retain it briefly solely to detect and prevent abuse.
6.5. Outputs generated by artificial intelligence (answers, suggestions and previews) are for information only and do not constitute decisions within the meaning of Article 22 GDPR.
7. Automated decision-making and profiling
7.1. Based on the User’s activity in the Service (liked, skipped, saved and purchased products), the Controller automatically assesses the User’s preferences in order to show more relevant products. This constitutes profiling within the meaning of Article 4(4) GDPR.
7.2. Profiling produces no legal effects and does not similarly significantly affect the User: it does not affect prices, product availability or contract terms, only the order and selection of products displayed. The Controller does not take decisions based solely on automated processing within the meaning of Article 22 GDPR.
7.3. When a payment is made, the payment service provider automatically assesses the risk of fraud and may decline the transaction on that basis. With regard to that assessment the payment service provider acts as an independent controller and ensures the User's right to obtain human intervention, to express their point of view and to contest the decision. The User may also contact the Controller via the contact in Section 1.2; the Controller will then review the order, offer another available payment method and forward the request to the payment service provider.
7.4. The User may object to profiling at any time and may reset the data on which personalisation is based in the app settings.
8. Connected users and joint product selection
8.1. Connected users. A User may accept an invitation from another user and share with that user a limited selection of products from the User’s activity in the Service, without dates or indication of source, together with the User’s first name without surname. Other data, including measurements, is not visible to the inviting person; the Service may use such data only to tailor gift suggestions, if the User has chosen to share it. Processing is based on the consent of the User sharing the data. In the app settings the User may end the connection, change permissions and disable the processing of their data in features based on artificial intelligence; such processing remains disabled until the User enables it.
8.2. Joint product selection. A User who starts and pays for a joint gift selection enables other users to join via a link. All participants see the first names (without surnames) of other participants, changes to the selection and who made them, the selected product options and engraving, the name of the gift recipient, the occasion and the greeting card, and receive notifications of changes and of the order. Payment, discount and delivery data is visible only to the paying User. The gift recipient, if a connected user, does not see the joint selection before the order is completed. The Controller does not collect or distribute money among participants.
8.3. Third-party data. A User who enters data of another person (in particular the name of the gift recipient) must have a valid basis for doing so. This data consists of that person’s name and the occasion. The Controller processes such data only for the purpose for which it was entered. Since the Controller has no contact details for that person, the information required by Article 14 GDPR is provided by this Policy (Article 14(5)(b) GDPR).
9. Recipients of personal data
9.1. The Controller discloses personal data only to the extent necessary for the relevant purpose, to the following categories of recipients:
a) hosting, data storage and authentication service providers;
b) artificial intelligence service providers, only with consent (Section 6);
c) payment service providers, including deferred payment where available, and fraud prevention service providers;
d) email and push notification service providers, including mobile platform operators;
e) error diagnostics and cookieless website statistics service providers;
f) weather forecast service providers, which receive only a location rounded to approximately 10 km, and map service providers for displaying the map of pick-up points;
g) sign-in and digital wallet service providers, where chosen by the User;
h) delivery and parcel locker service providers, for delivery only;
i) Jewelers, for the orders they perform and the buyouts they carry out (Section 9.3);
j) the website measurement and advertising service provider, only with consent (Section 14);
k) public authorities, where required by law;
l) accounting service providers and legal and tax advisers bound by confidentiality.
9.2. Recipients under points a) to h) and l) process data as processors under contracts pursuant to Article 28 GDPR, except to the extent that a provider (in particular the payment service provider) processes data for its own legal obligations, in which case it acts as a separate controller. A list of processors is available on request via the contact in Section 1.2.
9.3. The Jeweler, as a separate controller, receives the data needed to perform the order (name and surname, contact details, delivery or pick-up location, order content, order messages and, for made-to-order products, measurements, design and engraving) or to carry out the buyout of pre-owned jewelry (submission, photographs, messages and payout data), and processes it for its own obligations as seller or buyer. The Jeweler’s name is shown next to the product and in the order, and its full details on the invoice.
9.4. The Controller does not sell personal data.
10. Transfers to third countries
10.1. Certain recipients are established or process data outside the European Economic Area, including in the United States of America.
10.2. Transfers take place only subject to appropriate safeguards under Chapter V GDPR: on the basis of an adequacy decision of the European Commission (including the EU-U.S. Data Privacy Framework, where the recipient participates in it) or on the basis of standard contractual clauses adopted by the European Commission. A copy of the safeguards is available on request via the contact in Section 1.2.
11. Retention periods
11.1. Personal data is retained only for as long as necessary for the purpose of processing, as follows:
a) account data, preferences and activity, including designs, conversations and saved suggestions: for as long as the user account exists; deleted without delay upon account deletion, and saved content earlier when the User deletes it;
a1) data from use without an account: deleted after 90 days of inactivity, unless linked to an order, buyout or payment;
b) photographs and voice recordings for the features in Section 6: not stored, processed only while the feature is being performed; resulting previews are stored only on the User’s device;
c) suggestions the User does not save: only for the duration of processing, without permanent storage;
d) pre-owned jewelry buyout data: for the duration of the submission and, for an item bought out, for as long as necessary as a record of the buyout and for advertising the item;
e) order, invoice and payment data: for as long as required by accounting and tax regulations, for invoices in the Republic of Croatia as a rule 11 years; the Jeweler and the payment service provider retain it in accordance with their own obligations;
f) joint product selections: 90 days if closed or expired, 25 months if an order was placed; account deletion also deletes joint selections started by the User, while items the User added to selections of others remain without attribution;
g) usage data: for as long as the account exists, with records older than 180 days deleted on a regular basis;
g1) records of requests to artificial intelligence services, without the content of queries or results: 180 days, after which they are deleted automatically;
h) device identifier for notifications: until sign-out, disabling of notifications or account deletion;
i) technical error and crash data: 90 days;
j) security access logs: up to 7 days;
k) support communications: up to three years after the last message, and longer only where necessary for the establishment, exercise or defence of legal claims;
l) connected-user data: for as long as the connection exists, and at most for as long as the account exists;
m) data collected through cookies on the website: the periods stated in the cookie notice;
n) location data: not stored.
11.2. Upon expiry of the retention period, data is deleted or anonymised.
12. Data subject rights
12.1. Every data subject, including website visitors and persons whose data is entered by another user, has the right of access to personal data (Art. 15 GDPR); rectification of inaccurate data (Art. 16); erasure (Art. 17); restriction of processing (Art. 18); data portability (Art. 20); to object to processing based on legitimate interest, including profiling (Art. 21); and to withdraw consent at any time without affecting the lawfulness of processing before withdrawal (Art. 7(3)).
12.1a. Right to object. A data subject may at any time object to processing based on legitimate interest, including profiling; the Controller will then stop processing unless it demonstrates compelling legitimate grounds or the processing is necessary for the establishment, exercise or defence of legal claims. Objection to processing for direct marketing, including promotional notifications, is always possible, and processing for that purpose then stops.
12.2. Data export and account deletion are available directly in the app’s privacy settings. Other rights are exercised by a request sent to the contact in Section 1.2. The Controller responds free of charge, without undue delay and at the latest within one month of receipt. That period may be extended by up to two further months, taking into account the complexity and number of requests, in which case the requester is informed within one month, with reasons. The Controller may request additional information to confirm the identity of the requester.
12.3. For data processed by the Jeweler as a separate controller, the User may contact the Jeweler or the Controller, which will forward the request to the Jeweler.
12.4. Every data subject has the right to lodge a complaint with a supervisory authority, in the Republic of Croatia the Croatian Personal Data Protection Agency (Agencija za zaštitu osobnih podataka, AZOP), Selska cesta 136, 10000 Zagreb, azop@azop.hr, www.azop.hr, or with the supervisory authority of the Member State of their habitual residence, place of work or place of the alleged infringement.
13. Whether provision of data is required
13.1. The Service can be used without creating an account. Data required to create an account or to place an order, arrange delivery, make a payment or carry out a buyout is a contractual requirement: without it, an account cannot be created and an order or buyout cannot be performed. Data required by accounting and tax regulations is a statutory requirement.
13.2. The provision of all other data, including photographs, voice recordings, location data and the consents in Section 4, is voluntary. Withholding such data only means that the feature requiring it is unavailable.
14. Website and cookies
14.1. The Service’s website uses cookies and similar technologies that are not necessary for its operation only with the visitor’s prior consent given in the cookie notice. With consent, a measurement and advertising service provider receives data on the visit and content viewed, together with technical browser data, in order to measure and improve the Controller’s advertising. For the collection and transmission of that data, the provider is a joint controller with the Controller, and for its own further processing a separate controller. The name of that provider, its privacy policy and the essence of the joint controllership arrangement are set out in the cookie notice.
14.2. Without consent, these technologies are not activated and no data is transmitted. Consent may be withdrawn in the cookie settings on the website. Website visit statistics are collected without cookies and without data enabling identification of the visitor.
14.3. The mobile application does not use cookies or tracking technologies for advertising measurement or advertising. Sections 14.1 and 14.2 apply to the website only. The app stores a random installation identifier on the User’s device for error diagnostics; this storage is strictly necessary to provide the Service requested by the User and therefore does not require consent (Article 43(4) of the Croatian Electronic Communications Act).
15. Photographs and special categories of data
15.1. Photographs of a hand or face are processed solely for the feature the User starts and are not stored in the Controller’s systems (Section 11.1(b)).
15.2. Photographs are not processed by specific technical means for the purpose of uniquely identifying a person and therefore do not constitute biometric data within the meaning of Article 9 GDPR. The Controller does not create biometric profiles and does not recognise persons in photographs. When any photograph is processed, including virtual previews of jewelry on a hand or face, the User’s body, skin, face and age are not taken into account, except to the extent necessary to display the jewelry in the photograph. No inferences are drawn from photographs about the User’s health or other personal attributes.
15.3. Photographs of items submitted for buyout are kept in protected storage accessible only to the User, the Jeweler and the Controller. A photograph of an item that has been bought out is publicly available while the item is offered for sale.
16. Security of processing
The Controller applies appropriate technical and organisational measures pursuant to Article 32 GDPR, including encryption of data in transit and at rest, restriction of access to data to the user concerned and to authorised persons, protection of access credentials and regular backups. In the event of a personal data breach, the Controller acts in accordance with Articles 33 and 34 GDPR.
17. Minors
A user account may be created by persons aged at least 16. The Controller does not knowingly collect personal data of persons under 16. If it becomes aware that an account was created by a person under 16, it deletes the account and related data without delay.
18. Changes to this Policy
The Controller may amend this Policy to reflect changes to the Service or to legislation. The User is informed of material changes in the app before they take effect and, where required, is asked for consent again. The current version, with its effective date, is always available in the app and on the Service’s website.
19. Entry into force
This Policy enters into force on 5 November 2026 and replaces all previous versions.

9.4. Der Verantwortliche verkauft keine personenbezogenen Daten.
10. Übermittlung in Drittländer

19. Inkrafttreten
Diese Erklärung tritt am 5. November 2026 in Kraft und ersetzt alle früheren Fassungen.
